Terms.
General conditions of Sale and Business of John Moncrieff Limited a company incorporated under the Companies Acts (registered in Scotland Company No 209212 Registered Office c/o Robson Forth Ltd, 3 St Davids Business Park, Dalgety Bay, Dunfermline, Fife, KY11 9PF) and having a place of business at Unit 5 Clashburn Rd, Bridgend Ind Estate, Kinross, Perthshire, KY13 8GB.
Whereas John Moncrieff Limited specialises in the design and supply and subsequently the sale, of customised and specialist industrial glass and related activities AND WHEREAS the customer either by purchasing goods from John Moncrieff Limited, or by instructing John Moncrieff Limited to undertake work on glass or other materials provided by the customer is deemed to have accepted and deemed to have to agreed to be bound by these General Conditions of Sale and Business NOW THEREFORE IT IS AGREED AS FOLLOWS:
1.
DEFINITIONS
In these General conditions, unless the context otherwise require, the words and phrases set out will have the meaning set out opposite to them.
John Moncrieff Limited
means John Moncrieff Limited a company a company incorporated under the Companies Acts (registered in Scotland Company No 209212.) and having a place of business at Unit 5 Clashburn Rd, Bridgend Ind Estate, Kinross, Perthshire, KY13 8GB
Customer
means the person, firm or company which has submitted as order to John Moncrieff Limited, and which has been accepted as a Customer by John Moncrieff Limited.
Work
means the person, firm or company which has submitted as order to John Moncrieff Limited, and which has been accepted as a Customer by John Moncrieff Limited.
Quotation
means and assessment by John Moncrieff Limited of the cost of the work or the sale price of the goods
Purchase Order
means a formal written instruction from the customer to John Moncrieff Limited describing the work to be carried out
General Conditions
means these general conditions of sale and business
2.
DUTIES OF THE CUSTOMER
a. Payment
The customer will accept John Moncrieff Limited Terms and Conditions for payment whereas payment is due end on month following date of invoice.
b. Defective Goods
If the customer claims that any of the goods are defective, such goods must be returned to John Moncrieff Limited within 7 days of receipt, in the same condition as the goods were in when the goods were supplied. If the goods have been installed or now form part of a larger object and accordingly it is not practical to return the good the customer must notify John Moncrieff Limited in writing of the alleged defect within 7 days of becoming aware of the alleged defect. If John Moncrieff Limited agree that the goods are defective, John Moncrieff Limited at its absolute discretion will replace or repair the goods free of charge.
3.
TERMINATION
a
If the customer
(1)
Being a limited company, goes into receivership or liquidation, or being an individual, signs a trust deed for behalf of creditors, compounds with creditors, is sequestrated or made bankrupt, or
(2)
Fails to adhere to these General Conditions, John Moncrieff Limited, may at its absolute discretion cease work for the Customer and charge such amount for work done as may be equitable.
b.
If the customer
Fails to make payment when due, John Moncrieff Limited, may without prejudice to any other rights or remedies which it may have under the contract) suspend further deliveries to the customer until payment is made or may terminate the contract.
4.
RISK
a.
Unless otherwise indicated in the quotation, John Moncrieff Limited will arrange for delivery of the goods. If the goods are damaged or broken in transit the customer will notify John Moncrieff Limited in writing within 3 days of receipt. Arrangements may be made by John Moncrieff Limited for inspection of the goods.
Notification of any goods rejected by the customer for any reason other than breakage or damage in delivery must be received by John Moncrieff Limited within 7 days of delivery, please see our Returns Policy below.
b
The handling, working or carrying, of materials provided by the customer will be entirely at the Customers risk. All reasonable care will be taken by John Moncrieff Limited including the use of such adequate packing as is normally used in the glass industry. All goods uplifted by the Customer are at the Customers own risk.
5.
PROPERTY
a
Property of the goods will remain with John Moncrieff Limited until such time as the Customer shall have paid to John Moncrieff Limited the price in full.
b
The customer acknowledges that the customer is in possession of the goods solely as agent for John Moncrieff Limited until such times as the price has been paid in full, but that risk in the goods passed to the customer on despatch of the goods in accordance with condition 4 a of these general conditions.
6.
JURISDICTION and TERMS
The contract between John Moncrieff Limited and the customer is governed by the Law of Scotland. These General Conditions contain the entire agreement of the parties. These General Conditions may not be modified or varied except with the written agreement of the parties.
7.
NOTICES
Any notice in writing served pursuant of these General Conditions will be deemed to have been properly served if address to John Moncrieff Limited at is Scotlandwell office or to the Customer at the address shown in the Purchase Order. The date of service will be deemed to be date of delivery in the normal course of posting.
8.
RETURNS POLICY
Returns Policy & Guarantee:
All of our products come with a no fuss guarantee .In accordance with the EU Distance Selling Directive, you are entitled to cancel your order at anytime within 7 days of receiving your goods.
The cancellation period ends on the expiry of the period of 7 working days beginning with the day after the day on which you received the goods. If you wish to cancel an order under these terms, first contact us and then return your products unopened within 7 days of receiving your parcel.

Refunds:
If you are not satisfied with the goods and inform us within seven days of your receipt of the goods, you may return them and we will give a full refund. Or we will exchange items if they are faulty on delivery to you and we are notified within 10 days of the customers receipt of the product. All products to be returned must be carefully repackaged in their original packing.
The exception is custom made items, in this case a drawing or image will required to be signed off before manufacture. Custom made items cannot be returned.
